N2011 SUBS 794, 796 JUNE, 2001 KLAUSSNER FURNITURE CASE GOODS WARRANTY POLICY KLAUSSNER CASE GOODS WARRANTS THAT ITS PRODUCTS ARE FREE OF DEFECTS INMATERIALS AND WORKMANSHIP FOR ONE YEAR FROM THE DATE OF PURCHASE BY ITS CUSTOMER WHEN USED IN ACCORDANCE WITH THIS WARRANTY. KLAUSSNER CASEGOODS PRODUCTS ARE INTENDED SOLELY FOR RESIDENTIAL USE. KLAUSSNER CASE GOODS EXPRESSLY DISCLAIMS ANY OTHER WARRANTIES, EXPRESSED OR IMPLIED, IN FACT OR BY LAW, AND OF ANY OTHER OBLIGATION OR LIABILITY WHATSOEVER. KLAUSSNER CASE GOODS NEITHER ASSUMES NOR AUTHORIZES ANYONE TO ASSUME FOR IT ANY OTHER OBLIGATION OR LIABILITY IN CONNECTION WITH ITS MERCHANDISE. IT IS KLAUSSNER CASE GOODS POLICY TO BE FAIR AND REASONABLE IN AUTHORIZING THE DISPOSTION OF DEFECTIVE MERCHANDISE OR IN THE ISSUANCEOF ALLOWANCES WHEN NECESSARY. UNDER CIRCUMSTANCES, ALLOWANCES WILL BEAUTHORIZED BY KLAUSSNER CASE GOODS CUSTOMER SERVICE DEPARTMENT. SUCH ALLOWANCES TO BE COVERED INCLUDE LOCAL REPAIR CHARGES OR HELP TO DISPOSE OF DEFECTIVE ITEMS. UNDER NO CIRCUMSTANCES WILL ALLOWANCES AUTOMATICALLY BE GIVEN WHERE REPAIRS HAVE BEEN MADE PRIOR TO SALES REPRESENTATIVES INSPECTION AND FACTORY AUTHORIZATION. IF A PROBLEM ARISES, IT SHOULD BE REPORTED TO THE LOCAL KLAUSSNER CASE GOODS REPRESENTATIVE IF POSSIBLE, OR THE KLAUSSNER CASE GOODS CORPORATE OFFICE REPRESENTATIVE FOR RESOLUTION. WHILE WE STRIVE TO MAINTAIN THE HIGHEST QUALITY STANDARDS, MANY OR OURPRODUCTS UTILIZE MATERIALS WHERE SOME COLOR VARIATION WILL EXIST FROM TIME TO TIME. DEFECTIVE MERCHANDISE RECEIVED BY THE DEALER THAT IS A RESULT OF COMMON CARRIER FREIGHT DAMAGE, OR COMMON CARRIER CONCEALED DAMAGE, IS THE RESPONSIBLITY OF THE COMMON CARRIER AND CLAIMS MUST BE FILED WITH THE COMMON CARRIER WITHIN TEN (10) DAYS. THEREFORE, IT IS RECOMMENDED THAT THE DEALER INSPECT MERCHANDISE PROMPTLY UPON ARRIVAL IN ORDER TO AVOID REFUSAL OF A CLAIM. KLAUSSNER CASE GOODS WILL NOT ACCEPT OR GIVECREDIT FOR MERCHANDISE DAMAGED BY COMMON CARRIER. WHEN THE DEALER REFUSES MERCHANDISE AND RETURNS IT TO THE FACTORY, ALLFREIGHT OUTBOUND AND INBOUND WILL BE BILLED TO THE DEALER. NO CANCELLATIONS OF PURCHASE ORDERS WILL BE ACCEPTED UNLESS IT IS RECEIVED AND ACKNOWLEDGED BY OUR CUSTOMER SERVICE DEPARTMENT NO LESS THAN SEVEN (7) DAYS BEFORE SHIPMENT OF ORDER. ONLY CONFIRMED ORDERS WILL BE ENTERED. ALL SHIPMENTS WILL BE MADE BY THE MOST ECONOMICAL ROUTING WHEN NOT SPECIFIED BY THE DEALER.
