JCPenney “Yes Trip” Contest – Official Rules

NO PURCHASE NECESSARY. PURCHASE WILL NOT IMPROVE CHANCES OF WINNING. PROMOTION OPEN ONLY TO LEGAL U.S. RESIDENTS AT LEAST 18 YEARS OLD AT THE TIME OF ENTRY.

  1. The Promotion: The JCPenney “Yes Trip” Teacher Nomination (the “Promotion”) is a contest in which members of the public nominate a deserving teacher, by video, for the opportunity to attend a JCPenney “Yes Trip” retreat. Nominations are evaluated as described in Section 8. By participating, each Nominator agrees to be bound by these Official Rules and by the decisions of the Sponsor and its judges, which are final and binding in all matters relating to the Promotion.
  2. Sponsor: The Promotion is sponsored and administered by Penney OpCo LLC 6501 Legacy Drive, Suite B-100 Plano, TX 75024 (“Sponsor”). The Promotion is in no way sponsored, endorsed, administered by, or associated with TikTok, Instagram, Meta Platforms, Inc., or any other social media platform (each, a “Platform”). See the Platform Release at the end of these Official Rules.
  3. Agreement to Official Rules: Participation in this Promotion constitutes Nominator’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to this Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein.
  4. Promotion Period: The nomination period begins on September 7, 2026 at 12:00pm Central Daylight Time (“CDT”) and ends on September 20, 2026 at 11:59pm CDT (the “Promotion Period”). Entries submitted before or after the Promotion Period will not be eligible. Sponsor’s computer is the official time-keeping device for the Promotion.
  5. Who May Enter (Nominators): The Promotion is open only to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older at the time of entry. Employees, officers, directors, and agents of Sponsor and its parent, affiliates, subsidiaries, advertising and promotion agencies, and any Platform, and the immediate family members (spouse, parent, child, sibling, and their respective spouses) and persons living in the same household of each such person, are not eligible to enter. Void where prohibited or restricted by law. An individual who submits a nomination is a “Nominator.”
  6. Who May Be Nominated (Teachers): A Nominator may nominate any one (1) individual who: (a) is currently employed as a full-time educator in an accredited public or private kindergarten through twelfth grade (K–12) school located within the fifty (50) United States or the District of Columbia, both at the time of nomination and through final winner verification; (b) is at least eighteen (18) years of age (or the age of majority in their jurisdiction of residence); and (c) is not otherwise excluded from participation under Section 5 (each eligible individual, a “Nominee”). A Nominee must consent to the nomination, to being featured in the entry video, and to being bound by these Official Rules. Where the Nominee is an individual other than the Nominator, the Sponsor reserves the right to require the Nominator to provide proof that the Nominee has provided such consent. Self-nominations are permitted, provided the Nominator independently meets all applicable eligibility requirements and is not subject to any exclusions listed herein. Each eligible nomination submitted will earn the Nominator one (1) entry into the Promotion. Only one (1) Nominee may be featured per entry video; however, a Nominator may submit multiple unique entries to nominate different Nominees, provided each nomination is submitted as a separate video in accordance with requirements in Section 7.
  7. How to Enter: During the Promotion Period, a Nominator must:
    • Follow Sponsor: Follow @jcpenney on the platform used for submission (TikTok or Instagram) and remain a follower through the end of the Promotion Period.
    • Post an Original Video: Publicly post an original nomination video (on TikTok or as an Instagram Reel) that tags @jcpenney, includes the hashtag #JCPYesTrip, is between thirty (30) and ninety (90) seconds in duration, and:
      • Identifies the nominated teacher;
      • Describes the Nominator’s relationship to the teacher; and
      • Explains why the teacher deserves to be selected for the JCPenney “Yes Trip.”
    The Nominator’s social media account must be public at the time of entry and through the end of the Promotion Period so that Sponsor can view and evaluate the entry. Each qualifying video that satisfies these requirements is an “Entry.” Each piece of original content posted will be counted as an Entry; each Entry must be different. If a user posts the same content twice, it will only be counted as one Entry. An Entry that does not clearly and conspicuously disclose that it is an entry in the Promotion may be disqualified in Sponsor’s sole discretion.

    Entries generated by script, macro, bot, or other automated means, and entries that attempt to circumvent these Rules through multiple accounts or identities, are void. Proof of Entry is not proof of receipt. Sponsor is not responsible for Entries that are lost, late, incomplete, misdirected, not captured, or not viewable for any reason.

    Each Entry must be the Nominator’s own original content and must comply with the applicable Platform’s terms of service. By submitting an Entry, the Nominator represents and warrants that the Entry, and Sponsor’s use of it as permitted here, does not and will not infringe or violate any copyright, trademark, right of privacy, right of publicity, or other right of any third party, and does not violate any law. Each Entry must not contain any content that is unlawful, defamatory, obscene, hateful, harassing, sexually explicit, or otherwise objectionable, and must not depict any identifiable person (including the Nominee) without that person’s permission. Sponsor reserves the right, in its sole discretion, to disqualify any Entry or Nominator that it believes violates these Rules or is otherwise inappropriate.



  8. Winner Determination: This is a skill-based contest; winners are determined by merit, not chance, and there is no random drawing. Following the Promotion Period, on or about September 24, 2026, Sponsor will identify five (5) potential winning Nominees (“Potential Winners”) from among all eligible Entries. Potential Winners will be determined solely by the evaluation of a panel of qualified JCPenney team members against the following objective criteria: the strength and compelling nature of the story; the creativity and originality of the video; overall engagement; and the relevance of the Entry to the “Yes Trip” theme of celebrating deserving teachers. In the event of a tie, the tied Entry with the higher panel score for the overall strength and compelling nature of the story will be selected. Because winners are selected on the basis of skill, no odds of winning apply. All judging determinations are final and binding.
  9. Winner Requirements: On or about September 25, 2026, Sponsor will notify the Nominator whose Entry has been selected by direct message through the Platform used to submit the Entry and/or by other contact information requested by Sponsor. The winning Nominees will not be notified by Sponsor in the first instance. The Nominator must respond within three (3) business days of the date notice is first sent and, where the Nominator is not also the nominated teacher, must provide the information Sponsor requests to enable Sponsor to contact the winning Nominee and/or facilitate an introduction between Sponsor and the Nominee. Sponsor will then contact the Nominee. Each Nominee (i.e., the nominated teacher) must confirm availability to attend the retreat on the scheduled dates (see Section 10) and, except where prohibited by law, must complete, sign, and return an Affidavit of Eligibility, a Liability Release, and a Publicity Release (collectively, the “Winner Documents”) within three (3) business days of the date the Winner Documents are sent. If the Nominator fails to respond or to provide the requested information within the applicable period, or if a Potential Winner cannot be contacted, declines the prize, fails to confirm availability, fails to timely return the Winner Documents, is found ineligible, or otherwise fails to comply with these Rules, the applicable Entry will be disqualified, that Nominee will forfeit the prize, and Sponsor may, in its sole discretion, select an alternate Potential Winner based on the criteria in Section 8. A Nominee becomes a “Winner” only after Sponsor confirms eligibility and receipt of the properly completed Winner Documents.
  10. Prizes: Sponsor will award five (5) prizes, one (1) to each Winner. All five (5) prizes are identical. Each prize consists of one (1) spot for the Winner to attend the JCPenney “Yes Trip,” a three (3)-day, two (2)-night group retreat scheduled to take place in the Park City, Utah area on or about October 9–11, 2026. Each prize includes: (a) round-trip coach-class air transportation for the Winner from a major commercial airport near the Winner’s home to Salt Lake City International Airport; (b) accommodations at a luxury resort for the retreat dates (resort to be finalized by Sponsor); (c) ground transportation associated with the scheduled retreat; (d) group meals during the retreat; (e) planned group activities as determined by Sponsor, which are expected to include horseback riding, spa treatments, and guided yoga; and (f) gift items provided during the retreat. Approximate Retail Value (“ARV”) of each prize: $4,000. Total ARV of all prizes: $20,000. The prize is awarded only to the nominated teacher (the Winner); the Nominator receives no prize. Prize details not specified above are at Sponsor’s sole discretion. The prize consists only of those items expressly listed; all other costs and expenses (including meals and incidentals not specified, spending money, baggage fees, and any personal expenses) are the Winner’s sole responsibility. Travel and accommodations are subject to availability. The Winner must travel on the dates and itinerary designated by Sponsor; if the Winner is unable or unwilling to do so, the prize will be forfeited. Actual value may vary based on point of departure and travel-cost fluctuations, and any difference between stated and actual value will not be awarded. No cash redemption, substitution, assignment, or transfer of a prize is permitted by a Winner, except that Sponsor reserves the right to substitute a prize (or component) of equal or greater value if an advertised prize becomes unavailable. Limit one (1) prize per person or household.
  11. Taxes: All federal, state, and local taxes on a prize, and all expenses not expressly described as part of the prize, are the sole responsibility of the Winner. Where the value of a prize requires it, Sponsor may issue the Winner an IRS Form 1099 reflecting the ARV of the prize. Sponsor may require a Winner to provide a completed IRS Form W-9 (including a Social Security number) for tax-reporting purposes as a condition of receiving the prize.
  12. Sponsor’s Use of Entry: An Entry constitutes Nominator’s consent to give Sponsor a royalty-free, irrevocable, perpetual, non-exclusive license to use such Entry on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, including for promotional or marketing purposes. If requested, Nominator will sign any documentation that may be required for Sponsor or its designees to make use of the non-exclusive rights Nominator is granting to use the Entry.
  13. Release: By receipt of any prize, each winner agrees to release and hold Sponsor, and their respective parent companies, subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, damage to or loss of property, arising out of participation in the Promotion or receipt or use or misuse of any prize. This Release does not apply to claims for personal injury or death caused by the negligence of Sponsor.
  14. Publicity: Acceptance of any prize shall constitute and signify each winner’s agreement and consent that Sponsor, and its designees may use the winner’s name, city, state (and/or province), likeness, photo/video (including Social Account Profile photo), Entry, and/or prize information in connection with the Promotion for promotional, advertising or other purposes, worldwide, in any and all media now known or hereafter devised, including the Internet, without limitation and without further payment, notification, permission or other consideration, except where prohibited by law.
  15. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Promotion, as determined by Sponsor in its sole discretion. If terminated, Sponsor may, in its sole discretion, determine the winners from among all non-suspect, eligible Entries received up to time of such action using the judging procedure outlined above. Sponsor, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the Entry process or the operation of the Promotion or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner and void all associated Entries. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages and other remedies (including attorneys’ fees) from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
  16. Limitations of Liability: Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Nominator, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the Entry process or the Promotion; (4) printing, typographical, technical, computer, network or human error which may occur in the administration of the Promotion, the uploading, the processing or judging of Entries the announcement of the prizes or in any Promotion-related materials; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Nominator’s participation in the Promotion or receipt or use or misuse of any prize. Released Parties are not responsible for misdirected or undeliverable Entries or for any technical problems, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Released Parties are not responsible for any unauthorized third-party use of any Entry. Notwithstanding the foregoing, nothing in this Section 16 limits or excludes liability for personal injury or death caused by the negligence of Sponsor.
  17. Disputes: Except where prohibited, each Nominator agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by laws of the State of Texas, Dallas County; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees; and (3) under no circumstances will Nominator be permitted to obtain awards for, and Nominator hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Nominator and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Texas without giving effect to any choice of law or conflict of law rules (whether of the State of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas.
  18. Nominator’s Personal Information: Participation in the Promotion implies authorization to transfer personal data to the United States for purposes of administration of the Promotion. All information submitted to the Sponsor as part of this Promotion will be treated in accordance with the Sponsor’s privacy policy, available at www.jcpenney.com/m/privacy-notice.
  19. Winner List: For the names of the Winners, available after September 25, 2026, send a self-addressed, stamped #10 envelope by March 25, 2027 to: JCPenney’s Legal Department, located at 6501 Legacy Drive, Plano, Texas 75024, with a copy to: svclegalsparc@catalystbrands.com
