This Privacy Notice describes how JCPenney collects, uses, shares, and protects your personal information. By interacting with JCPenney through our stores, websites, mobile applications, products, and services (“Services”), affiliates, and partners, you consent to the use of information that is collected or submitted as described in this Privacy Notice.

- Sign up to receive email or text messages about your transaction and/or delivery status.
- Sign up to join the JCPenney loyalty/rewards program.
- Submit a request to the customer service team.
- Participate in surveys, focus groups, or feedback programs.
- Open a JCPenney account or JCPenney credit card.
- Interact with JCPenney's social media accounts.
- Book an appointment at a JCPenney Salon.
- Install and use the JCPenney mobile app.
- Browse through the JCPenney website.
- Click or interact with sponsored links or third-party advertisements.
- Use JCPenney store WI- FI services.
- Enable location-based services on JCPenney platforms.
- Receive or interact with JCPenney communications or a JCPenney digital service that may contain cookies.
We may receive your personal information from other third-party sources, like JCPenney’s business partners, co-sponsors, and third-party advertising networks. We may also receive personal information from our services providers, data analytics companies, and third-party technology companies who assist JCPenney in providing you with a better and more personalized shopping experience.
Cookies on our services
When you use our Services, you may receive cookies from us and the third parties that collect information on our Services. We use cookies to determine if we are providing you with a high-quality experience. We also use cookies to show you advertising that is relevant to you. If you continue to browse our website without changing your web browser or device settings that control cookies, you agree to receive cookies when you use our Services. Our Services occasionally use "local shared objects" (also known as "Flash cookies"). Upon completing the above steps, JCPenney will place a cookie on your browser or JCPenney app, which is device and browser specific. If you remove or delete your cookies, upgrade the version of your browser, or visit the JCPenney website or app from a different device or browser, you will need to repeat the steps above. Also, if you choose to opt-in later, you will need to repeat the steps and update your preferences.
NOTE: If you face challenges launching the Cookie Preferences interface, please disable all Ad Blockers and Anti-Trackers from your browser and try again. Ad Blockers and Anti-Trackers can be turned on again once you have submitted the Cookie Preferences.
How we use your Personal Information
In addition to the information, we collect to offer, improve, and provide our products and services, JCPenney may use personal information for administrative and analytical purposes. We may combine or use the services of third parties to combine information to create a more complete customer profile, as provided by applicable law.
In addition, JCPenney may use your personal information for several purposes, including, without limitation:
- Business purposes and communication: To provide products, services or information you requested; to communicate with you for business, consumer service or other such reasons like changes to our policies or in response to an inquiry. Performing services on behalf of the business or service provider, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying your information, processing payments, providing financing, advertising or marketing services, providing analytic services, or similar services on behalf of the business or service provider
- Marketing: To provide consumers with personalized marketing or coupon offers through various media, including but not limited to direct mail, email, social media advertising, digital banners, SMS (text) messages, and internet-connected TV. Short-term, transient use provides personal information that is not disclosed to another third party and is not used to build a profile about you or otherwise alter your experience outside the current interaction, including, but not limited to, the contextual customization of ads shown as part of the same interaction. We may audit current interactions and concurrent transactions, including, but not limited to, counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with this specification and other standards.
- Financials transaction management: To facilitate payment for products and services or provide refunds.
- Legal and regulatory obligations: To comply with legal, regulatory, or fiscal obligations, or in connection with litigation, an internal investigation or audit, or to protect legal rights.
- Research: To engage in consumer research and analytics for generating insights on browsing and buying activities; undertaking internal research for technological development and demonstration.
- Site and Device maintenance: To identify and repair errors that impair existing website’s functionality; undertaking activities to verify or maintain the quality or safety of, improve, upgrade or enhance a service or device that is owned, manufactured, manufactured for, or controlled by the business.
- Security management: To detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity or prosecute those responsible for that activity, and secure JCPenney’s premises, assets, and information.
- Third party requests: To respond to and comply with outside requests initiated by you, as well as in response to legal requests;
- Audit and controls: To evaluate internal controls and audits for compliance (including those conducted by JCPenney’s internal and external audit service providers); and
- Deidentified / Aggregated Consumer Information: To collect, use, retain, or disclose personal information that is deidentified or aggregated.
As noted above, we may use the information we collect and receive to personalize your JCPenney experience across channels. We may combine information to link your activity through one channel to your activity in another, such as linking information from your in-store activity to your activity on our websites or linking your activity from one device to another, such as from a mobile device and a laptop computer. There are Closed Circuit Television (CCTV) cameras in operation within and around our stores and other premises, which are used to:
- Prevent and detect crime;
- Protect the health and safety of JCPenney’s consumers and employees;
- Manage and protect properties of JCPenney, its guests, and other visitors; and
- Quality assurance purposes.
Disclosure of Personal Information with others
General
We may disclose information to companies affiliated with JCPenney and/or unaffiliated third parties to provide the products and services you have requested and for administrative, analytical, and/or marketing purposes. For example, we may provide the information we collect about you to third parties to distribute promotions, marketing surveys, focus groups, and other opportunities offered by JCPenney. JCPenney does not use or disclose sensitive information unless it is necessary to provide the goods or services you have requested (such as processing or fulfilling orders and transactions) and does so only with your consent or as otherwise authorized by applicable law.
We may share information in the following circumstances:
- JCPenney family: We share information we collect with affiliated companies and licensees (e.g., the optical and photography departments in our stores) within the JCPenney family of businesses.
- Service providers: We disclose or otherwise make available information we collect with other companies that help with our business operations. Examples include providers of services related to e-mail and text communications, marketing, analytics, product fulfillment, web hosting, payment processors, and other entities that help us market our products and services. In addition, we use third parties to assist with fraud detection and to validate aspects of Consumer transactions.
- Third-party marketing: We may provide information about you to third-party companies or organizations. These entities may use that information to market their products and services to you. To opt-out of such sharing, go to the "Your Choices Regarding Your Personal Information" section of this notice;
- Legal or safety requirements: We may disclose information we collect when we are legally required to do so, to enforce or apply applicable terms and conditions and other agreements; or to protect the rights, property, or safety of our business, our consumers or others.
- Business transfers: If the ownership of JCPenney, or all or part of a business within the JCPenney family were to change, information about consumers pertinent to JCPenney or that business’s operations would likely be transferred to, or licensed for use by, the new owner. The applicable member of the JCPenney family might also retain a copy of that information.
- Sharing aggregate Information: We may share aggregate information (information that does not directly identify any individual) with third parties for lawful purposes.
- Benefit administration: JCPenney may share your personal information collected in relation to your JCPenney Rewards with third-party benefits administrators.
Your Privacy Rights
Depending upon where you reside and the applicable laws in your jurisdiction, you may have access to certain privacy rights. JCPenney will not deny, charge different prices for, or provide a different level or quality of goods or services should a consumer choose to exercise these rights.

Sale of Personal Information, targeted advertising, and profiling
JCPenney may process personal information for targeted advertising and profiling to better offer you products and services. JCPenney may place an “opt-out” cookie on your device if you choose to opt out. Therefore, your browser must be set to accept cookies. In addition, you will need to exercise your opt-out should you visit www.jcpenney.com or our app on a different device.

To help protect your privacy and maintain security, we will take steps to verify your identity before granting you access to your personal information or complying with your request. To exercise these rights, you will be asked to provide certain information depending on the type of request, which we will solely use to verify your identity.
We will use this information to search our systems and determine if we have information about you. If we can locate information about you, we will fulfill your disclosure, correction, and/or deletion request within 45 days, unless an allowable extension is necessary. If you do not provide the information requested, we will be unable to process your request.
Authorized Agent
If you are an authorized agent making a request on behalf of a consumer, you must submit your name, address, email, and phone number as well as the name, address, email, and phone number of the person for whom you are making the request. As an Authorized Agent, you will also be required to certify that you have the right to make this request on behalf of the Consumer. JCPenney will use the requestor’s information to determine if we have information about the Consumer. If we can locate information about the Consumer, we will fulfill the request.

JCPenney’s Privacy Notice covers our information practices for the last 12 months regarding the categories of personal information we have collected (under the "Types of personal information we collect" and "How we collect your personal information" section of this Privacy Notice) and the purpose for which we collect your information (under the "How we use your personal information" ) and with whom we share your personal information (under the "Disclosure of personal information with others" section of this Privacy Notice). Financial Incentive
JCPenney Rewards is a loyalty program sponsored by JCPenney and is subject to the Program Terms and Conditions. By participating in JCPenney Rewards and its associated benefits (collectively, “JCPenney Rewards”), you are opting in (consenting) to the collection, use, and sharing of certain personal information about you in order for JCPenney to offer you a different price, rate, level, quality, or selection of goods or services.
- You may opt-in to participating in JCPenney Rewards by completing the enrollment process either in-store or online at jcpenney.com. Additionally, you will be automatically enrolled in JCPenney Rewards with a JCPenney Credit Card or JCPenney Mastercard credit account, or by creating a jcpenney.com account.
- You can withdraw from participating in JCPenney Rewards at any time by contacting us at 1.800.322.1189.
- To the extent that the benefits you receive through participating in JCPenney Rewards constitute a financial incentive, such benefits are reasonably related to the value of your personal information.
- JCPenney does not discriminate against any California consumer that exercises a right under the California Consumer Privacy Act of 2018, as amended, in connection with any JCPenney Rewards benefits.

Children’s privacy
We do not knowingly collect personally identifiable information from minors under the age of 16 through our websites or mobile applications.
Safeguarding the information, we collect
We have administrative, technical, and physical safeguards to protect the personal information we obtain. Please note that we never email you asking for personal information (like your account access credentials, date of birth, or credit card information). Retention of Personal Information
JCPenney retains personal information for a period permitted in accordance with applicable law and for the purposes set forth in this Privacy Notice. We dispose of the information we collect in accordance with JCPenney’s retention policies and procedures.

Postal Mail
If you do not want to receive coupons and other promotional mail, please send your request with your full name and mailing address to Penney OpCo LLC, P.O Box 10001, Dallas, TX 75301-7311, Attention: Corporate Customer Care or call us at 1.800.322.1189. Please allow us up to 6 weeks to remove your information from our mailing list.
If you do not want to receive promotional email offers and updates from JCPenney you may opt- out, by clicking on the “unsubscribe” hyperlink contained in our promotional emails. Please note we may still contact you by email for transactional purposes. Some examples are communications regarding your order status, JCPenney Rewards if you are a member, consumer service inquiries, service or reminder notices, and product recalls. Please allow us up to 30 days to remove your information.
Mobile Marketing:
If you are currently receiving promotional text alerts from JCPenney, you may unsubscribe at any time by texting STOP to 527365. After we receive your opt-out, we will send you a final text message to confirm the opt-out.
Transaction Text:

Push Notification:
If you have enabled alerts or push notifications from JCPenney, you may update your push notification preference by adjusting the notification settings provided by your device manufacturer.
